Rivers State Governor, Rotimi Chibuike Amaechi, yesterday slammed the Attorney General of the federation; Mr. Michael Aondoakaa and the Chairman of the Economic and Financial Crimes Commission, Mrs. Farida Waziri for though being lawyers, do not abide by the rule of law.

He sounded a note of warning that Waziri would no longer be let into Rivers State until she has appealed a Federal High Court judgment which said that the power to vet the State account rests in the State house of Assembly

Amaechi, who spoke at the Nigerian Bar Association National Executive Committee meeting in Port Harcourt yesterday said there was no better forum for him to ventilate the idea other than in a forum for legal practitioners.

He titled the paper, “judiciary, heal thyself” and pointed out that the people who were superintending the disobedience of court orders and judgments were all lawyers who should know better, pointing out that even if a judgment was defective, it subsists until set aside by a court of superior jurisdiction.

“One of the principal offenders in this regard is the EFCC. EFCC was set up by an Act of the law of this country and it cannot act outside the law. There is a judgment of the Federal High Court that says EFCC cannot investigate the account of the State.

“I have challenged EFCC to appeal the judgment because a time has come for us to challenge the Constitution where we feel it is defective. We will not allow them (EFCC) into Rivers State anytime because there is a judgment and before they can come here, they have to vacate the judgment”, Amaechi said.

He regretted that what the EFCC was doing was to take people to courts of public opinion where they are condemned before they even face the law, pointing out that an accused is presumed innocent until otherwise proved, " since we are not living in a police state".

The Governor said he had advised Waziri in secret and was forced to come to the open to make her appeal the judgment, which he said was a constitutional issue.

On the issue of Aondoakaa, he lamented that it was only in Nigeria that an Attorney General who is the first law officer of the nation would superintend the disobedience of a court judgment once it is not favourable to the government.

He gave an example of the case where the AG through a letter he signed, ceded some oil wells to Akwa Ibom whereas there is a subsisting Supreme Court judgment where uncloss was used as the barometer for determining who owns which oil well.

He expressed regres that a letter signed by the AG could suffice in the face of the decision of the apex court and vowed he was going to insist that the lead judgment by Justice Oguntade in Abia State and 35 others versus the Federal Government of Nigeria was there for all to see on the resolution of the littoral States and oil well ownership.

He condemned the ceding of over 80 oil wells belonging to Rivers State to Akwa Ibom, and pointed out that he will not only challenge the ceding of the wells in court but the entire 186 wells involved.

“But the Attorney General used an ordinary letter which he signed to give our oil wells to Akwa Ibom. They would not have taken our oil wells under the rule of law.

He lamented that the Niger Delta region was always suffering from neglect and unfair treatment by the federal government, pointing out that whereas the federal government went to Lagos to see Apapa road which went bad but would not do anything about the east-west road which has been in a very terrible state for a long time.

“Incidentally, they went to see Apapa where they will still use the resources from here to repair but the ones here have been left unattended to. We had to resort to use of State resources to repair the roads which belong to the federal government”, he lamented.

As at the last count, he said the State had spent over N50 billion on federal projects like Eleme flyover, East West road, and the road linking Owerri and Port Harcourt. among others.

Court Begins Trial Of Amaechi's Aide May 5

A High Court of the Federal Capital Territory (FCT) on Tuesday, fixed May 5 for the commencement of the trial of the Chief of Staff of Rivers State Government, Ezebunwo Nyesom Wike, over alleged illegal diversion of monies belonging to the state government.

The court, presided over by Justice Folashade Ojo, also dismissed the preliminary objection filed by the accused person, challenging the competence of the charge against him.

Wike is facing a seven-count charge of criminal breach of trust and illegal diversion of public fund.

The court directed the Economic and Financial Crimes Commission (EFCC) counsel, Rotimi Jacobs, to make available its witnesses on May 5, for the commencement of trial in the case.

But the trial may not go on as scheduled, as the accused person had disclosed that he would challenge the competence of the charges against him at the Appeal Court.

Wike is contending that the trial judge ought to have quashed the charge for dearth of evidence.

He insiste d through his team of lawyers led by Lateef Fagbemi (SAN), that the charges were nothing but mere fabrications.

According to him, each of the allegations lacked legal foundation and must, of necessity, collapse.

Meanwhile, Rivers State Government has assured Wike that it would stand by him through the case.

Magnus Abe, Secretary to the State Government, said he had reviewed the charge against Wike, and had discovered that they lacked substance.

He said Wike was simply being persecuted by certain political detractors, with a view to discrediting the state government.

The SSG assured that the case would not, in any way, make the government lose its focus.

It would be recalled that Wike was arraigned on October 24, 2008 before Justice Adebukola Banjoko, who had earlier granted him bail.
